By signing below, the Owner acknowledges that they have read, understood, and agree to all the terms and conditions outlined in this Agreement.

1. Dress Submission and Availability for Try-On Space

The Owner agrees to provide their dresses to Couture Hire by Mel for display and use in the try-on space, pickups, and deliveries.

The Owner shall ensure that all dresses provided are in good, wearable condition and suitable for hire. Couture Hire by Mel will be responsible for organising and maintaining the try-on space, pickups, deliveries, marketing, communication with potential customers, and dry cleaning of dresses.

2. Dress Condition and Return Process

The Owner agrees to ensure that all dresses are clean, free from damage, and suitable for hire at the time they are provided to Couture Hire by Mel.

 Upon return of the dress by a customer, Couture Hire by Mel will inspect the item and notify the Owner of any damage, excessive wear, or if the item is not returned.

3. Damages

In the event of any damage to a dress while in the customer's possession, the customer will be liable for the cost of repair or replacement.

If the damage is not repairable, the customer will compensate Couture Hire by Mel for the recommended retail price (RRP) of the dress to facilitate its replacement. Couture Hire by Mel will inform both the Owner and the Customer of the damage immediately upon receiving the dress and will provide evidence of the damage.

4. Theft Prevention and Order Verification

All orders placed through our website require valid contact details, including a phone number and email address.

These details are collected to ensure that, in the event of theft or fraud, orders can be traced and reported to the police if necessary.

Our Shopify website is programmed to flag orders as high or medium risk based on factors such as accounts previously associated with fraud or theft, or when the payment details do not match the account information.

For flagged orders, we will contact the customer to request a valid photo ID and proof of identity. If the customer is unable to provide acceptable verification, we reserve the right to cancel the order to protect against fraudulent activity.

5. Commission Structure

For each hire, the Owner will receive 40% of the hire fee ("Commission").

Couture Hire by Mel will handle all marketing, customer inquiries, delivery, returns, repairs, and cleaning.

The Commission will be paid to the Owner within 3 days following the completion of the hire. The Owner will be notified each time the dress is booked through their selected email address.

6. Wear and Tear

Couture Hire by Mel will take all reasonable steps to ensure the dresses are returned in a condition suitable for future hires.

However, the Owner acknowledges that reasonable wear and tear may occur over time due to the nature of the hire process. The definition of reasonable wear and tear can be found in our Terms and Conditions on the website.

This means that any reasonable wear and tear that occurs will not affect the wearability, overall appearance, or functionality of the dress, and it acknowledges that because dresses are worn often, some wear over time is inevitable with any garment.

7. Liability and Responsibility

Couture Hire by Mel will take all reasonable steps to care for the dresses during the hire process; however, the Owner acknowledges and accepts that Couture Hire by Mel cannot be held liable for any loss, theft, or damage that may occur during the hire period. The Owner will always remain the legal owner of the dress.

8. Duration and Termination of Agreement

This Agreement will remain in effect if the Owner continues to provide dresses for hire.

Either party may terminate this Agreement at any time with 10 days’ written notice.

Upon termination, Couture Hire by Mel will return any dresses currently in their possession, subject to inspection for damage.

9. Confidentiality and Privacy

Couture Hire by Mel agrees to keep all personal information provided by the Owner confidential, in accordance with applicable privacy laws and regulations.

The Owner acknowledges that any sensitive information provided for the hire process will be used solely for the performance of this Agreement.

10. Entire Agreement

This Agreement constitutes the entire understanding between the Parties with respect to the subject matter hereof and supersedes all prior agreements, understandings, or communications, whether oral or written, regarding the hiring of dresses.
