Contract Term: The maker will receive 60% of the retail price, and Uni-T will receive 40%. This arrangement applies only to in-store sales, and we cannot guarantee display on our website.
Artwork Information: A consignor who delivers a work of fine art hereunder shall, upon delivery of the work of fine art, furnish to the consignee a separate written statement of delivery of the work of fine art, which shall include at a minimum the following information:—
(1) the artist's name and the name of the owner of the work of fine art;
(2) the title, if any, of the work of fine art;
(3) the medium and dimensions of the work of fine art;
(4) the date of completion of the work of fine art;
(5) the date of delivery of the work of fine art; and
(6) the anticipated fair market value of the work of fine art.
Payment Options: If the maker's items are sold, a corresponding report and payment will be made every month. There are three ways of receiving payments:
Use of Photos & Descriptions: The product photos and descriptions provided by the maker may be used on Uni-T's website, Http://Www.shopuni-T.com. Uni-T will either download them directly from the maker's website or request additional photos. The maker retains all rights to these materials. Uni-T may also take product photos of the maker's products. If the maker wishes to use these photos, they must share the link from Http://www.shopuni-T.com and strictly prohibit downloading them from the Uni-T website and social media platforms.
Price: Uni-T will promote, display, and sell the maker's artwork. Uni-T reserves the right to adjust retail prices based on market demand and other factors and will notify the maker before making changes.
Customers: Uni-T customers making purchases in-store or online are bound by the Uni-T contract. Makers are prohibited from directly contacting or making sales to Uni-T customers.
Insurance: Uni-T will make every effort to maintain all items in sellable condition. However, unexpected and destructive circumstances can arise. Uni-T will not provide insurance for any artwork under $500.00. Insurance is the sole responsibility of the maker. Consignment items are owned by the maker and cannot be taken by creditors in the event of store bankruptcy.
Tax: Uni-T is responsible for collecting and remitting all Massachusetts state sales tax on behalf of the maker for work sold at Uni-T. However, it is the maker's responsibility to file their own income taxes based on the monthly report sent by Uni-T. Uni-T will not resend sales reports near the tax season, so it's the maker's responsibility to ensure proper organization for their own bookkeeping.
Effective Date: The contract lasts for 12 months and begins when the artist signs it. It will automatically renew unless one of the parties decides to opt out. Uni-T has the right to keep the artist's unsold merchandise on consignment for an additional 6 months, or return any unsold items to the artist. Uni-T can also remove the artist's work as necessary. At the end of the season, Uni-T can change out items due to seasonal changes, demand, style, or sizing. If this happens, Uni-T will notify the artist before making any removals. Artists cannot remove items or change prices from October to December.
